Terms of Service

For People Who Chat or Speak With Our AI Agents

Who these terms are for. These terms apply to you as an individual when you send messages to, or speak with, an AI agent powered by the Anita24 platform — on a website chat, on WhatsApp, Messenger or Instagram, or on the phone. They are written in plain language on purpose.

These are not the terms for organizations. If your organization uses Anita24 to run its own AI agents, the agreement that applies is the Customer Terms of Service at https://anita24.com/terms.

You accept these terms by tapping "I agree" in the chat before your first message, or by continuing to communicate with an Agent after being shown this notice.

1. Definitions

• Luminata

Luminata Software Development LTD, an Israeli company, which provides the Anita24 platform.

• The Service

The Anita24 platform, provided by Luminata, through which an Agent communicates with you.

• Agent

The AI agent you are writing to or speaking with. It communicates with you on behalf of an organization, over web chat, messaging apps, and telephone calls.

• Providing Organization

The business, municipality, clinic, school, or other organization that uses Anita24 and has deployed the Agent you are talking to. It chooses what the Agent knows, what it says, and what it can do. In the Customer Terms of Service, this organization is called the "Customer".

• You / End User

Any individual who communicates with an Agent.

• User Content

Anything you send to an Agent: messages, spoken words, files, images, and the contact or request details you choose to share.

2. Who you are dealing with

2.1 You are being served by the Providing Organization, not by Luminata. Luminata supplies the technology the organization uses. Questions, complaints, requests, appointments, orders, payments, and any commitments made in the conversation are the responsibility of the Providing Organization.

2.2 The Providing Organization’s own terms and privacy notice also apply to you, in addition to these terms. If they conflict with these terms on a matter concerning the organization’s own services, the organization’s terms prevail.

2.3 You are talking to an AI agent, not a person. The Agent generates its replies automatically. A human may join the conversation if the Providing Organization offers that.

2.4 The agreement between Luminata and the Providing Organization is the Customer Terms of Service at https://anita24.com/terms. Nothing in that agreement gives you rights against Luminata, and nothing in these terms makes Luminata responsible for the organization’s services.

3. Using the Service

• Cost

3.1 Luminata does not charge you for talking to an Agent. The Providing Organization pays for the platform. Your mobile carrier or messaging app may still charge you for calls or data at their normal rates.

• No account

3.2 You do not need to register or create an account with Luminata to use an Agent.

• Age

3.3 The Service is not directed at children. If you are under the age required by the law where you live to agree to these terms on your own, please do not use an Agent without the involvement of a parent or guardian. Some organizations — a school, for example — may deploy an Agent for younger users; where that happens, the organization is responsible for the extra protections the law requires.

• Permitted use

3.4 Communicate in good faith with an Agent to get information or support, or to complete a request with the Providing Organization.

• What you must not do

3.5 Do not: (a) send unlawful, threatening, harassing, hateful, defamatory, discriminatory, or sexually explicit content; (b) send content that infringes someone else’s rights, or personal information about other people that you have no right to share; (c) impersonate another person or organization; (d) attempt to defraud or mislead the Providing Organization; (e) send malware, or attempt to attack, overload, probe, or interfere with an Agent or the Service; (f) attempt to make an Agent ignore its instructions, reveal its underlying configuration, or behave in a way the Providing Organization has not authorized; (g) use automated tools to send messages at scale or to scrape conversations; or (h) use an Agent for any purpose prohibited by law.

4. What you send us

4.1 What you send an Agent becomes part of the conversation record for that conversation.

4.2 The Providing Organization can see the conversation record, including any files you attach and, for telephone calls, any recording or transcript.

4.3 As between Luminata and the Providing Organization, the Providing Organization holds the conversation records. Luminata handles them only as described in the Privacy Policy and on the organization’s instructions.

4.4 Please do not send sensitive information — such as identity-document numbers, payment card details, passwords, or health information — unless the Agent specifically asks for it and you are comfortable providing it.

5. Consent and privacy

5.1 Before your first message, the chat shows you a notice and asks you to agree. Tapping "I agree" is your acceptance of these terms and your acknowledgement of the Privacy Policy. You can stop using an Agent at any time.

5.2 The Providing Organization decides what personal data is collected through the Agent and why, and is responsible for obtaining any consent the law requires and for answering your privacy requests. Luminata processes that data on the organization’s behalf.

5.3 How your data is handled is described in the Privacy Policy for End Users at https://anita24.com/privacy-policy-en.html (Hebrew: https://anita24.com/privacy-policy-he.html).

5.4 You can ask us to stop processing your data by emailing support@anita24.com. Because the Providing Organization decides how your data is used, we will pass your request to that organization and act on it as the law requires and as the organization instructs. Requests about the organization’s own records should also be sent to that organization.

6. Phone calls: recording and transcription

6.1 Where the Providing Organization has enabled telephone Agents, calls with the Agent may be recorded and converted into text so that the organization has a record of the conversation.

6.2 You will be told at the start of the call that the call is handled by an AI agent and that it may be recorded and transcribed. If you do not want to be recorded, you can end the call and contact the organization another way.

6.3 If the Agent takes a message for the organization when nobody is available, that message and its transcript are shared with the organization in the same way.

6.4 Recordings and transcripts are held and deleted as described in the Privacy Policy for End Users.

7. Calls or messages you did not ask for; opting out

7.1 A Providing Organization may use the platform to contact you — for example to follow up on a request, confirm an appointment, or, where it is permitted to do so, to reach out to you. The organization, not Luminata, is the sender and is responsible for having a lawful basis and any consent required to contact you.

7.2 You can opt out at any time. Tell the Agent during a call or chat that you do not want to be contacted again, follow the opt-out instructions in the message, or email support@anita24.com. We record the opt-out and apply it to further outbound contact that organization makes through the platform. If more than one organization contacts you through Anita24, tell us and we will apply your request to each organization you name.

7.3 Opting out of outbound contact does not stop you from contacting the organization yourself, and does not by itself cancel any service you have with it.

8. Security

8.1 Conversation data and attachments are encrypted in transit and at rest.

8.2 Access is limited to the Providing Organization that deployed the Agent, authorized Luminata personnel who need access to operate and support the platform, and the service providers listed in the Privacy Policy for End Users who process data on our behalf under contract.

8.3 Each organization’s data is kept separate from every other organization’s.

8.4 No system is completely secure. We cannot guarantee that unauthorized access will never occur.

9. Intellectual property

9.1 Luminata owns the Service, the software, the interfaces, and the Anita24 brand. The Providing Organization owns its own brand, its knowledge base, and its conversation records.

9.2 You keep ownership of your User Content.

9.3 You grant the Providing Organization and Luminata a non-exclusive, royalty-free licence to store, reproduce, and process your User Content solely to run the conversation, deliver the service you asked for, keep the platform secure, and meet legal obligations.

9.4 Your User Content is not used to train or fine-tune general-purpose generative AI models, and our agreements with the AI providers we use do not permit them to do so.

10. What the Agent says: important limitations

10.1 The Agent’s answers are generated by artificial intelligence. They may be wrong, incomplete, or out of date, even when they sound confident.

10.2 The Agent’s answers are not professional advice. They are not medical, legal, financial, tax, insurance, psychological or other professional advice, and must not be relied on as a substitute for a qualified professional.

10.3 Do not use an Agent in an emergency. If there is a risk to life, health, or safety, contact the emergency services in your country immediately.

10.4 Before acting on anything important the Agent tells you — deadlines, eligibility, prices, opening hours, medical or legal consequences — confirm it directly with the Providing Organization.

10.5 The Service may be unavailable or interrupted at times. If something the Agent said seems wrong or harmful, please report it to the Providing Organization or to support@anita24.com so it can be reviewed.

11. Liability

11.1 Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, for fraud, or under mandatory consumer protection or data protection law. Your statutory rights are not affected.

11.2 The Providing Organization is responsible for the services it provides to you, for the information it configures its Agent to give, and for any commitment its Agent makes on its behalf.

11.3 To the fullest extent permitted by law, and subject to clause 11.1, Luminata is not liable to you for: indirect or consequential loss; loss of profits, revenue, data, or goodwill; loss arising from an inaccurate or incomplete answer generated by an Agent; or interruptions caused by third-party networks, messaging platforms, or service providers.

11.4 To the fullest extent permitted by law, and subject to clause 11.1, Luminata’s total liability to you in connection with the Service is limited to [liability cap amount — to be confirmed by counsel].

12. Stopping the service

12.1 You can stop using an Agent at any time.

12.2 We may suspend or stop access to an Agent where it is being used in breach of these terms, where required by law, or where the Providing Organization stops using the platform.

12.3 If an Agent is withdrawn, the Providing Organization remains responsible for its own records and for continuing to serve you through its other channels.

13. Privacy Policy

Our data practices are described in the separate Privacy Policy for End Usershttps://anita24.com/privacy-policy-en.html (Hebrew: https://anita24.com/privacy-policy-he.html). It explains what data is collected and why, how it is stored and protected, how long it is kept, who it is shared with, and how to exercise your rights. By using the Service you confirm you have been given the opportunity to read it.

14. Questions, complaints and requests

14.1 Questions about the organization’s service, or about information the Agent gave you, should go to the Providing Organization first.

14.2 Requests about your personal data — access, correction, deletion, objection, or opting out of contact — can be sent to support@anita24.com. We will act on them as required by law and, where the Providing Organization is the controller, will pass them to that organization and assist it in responding.

14.3 Formal legal notices to Luminata should be sent to Admin@anita24.com.

14.4 We will handle requests in accordance with applicable law. Nothing in these terms limits any right you have to complain to a supervisory or regulatory authority.

15. Changes to these terms

15.1 We may update these terms. The current version is identified by the "Last updated" date at the top.

15.2 If we make a material change, we will show the updated notice in the chat and ask you to accept it again before you continue.

15.3 Providing Organizations are responsible for telling their own users about changes to their own terms.

16. Governing law and courts

16.1 These terms are governed by the laws of the State of Israel, without regard to conflict-of-law rules.

16.2 The competent courts of Tel Aviv-Jaffa, Israel, have jurisdiction.

16.3 If you are a consumer resident outside Israel, this clause does not deprive you of the protection of mandatory consumer laws of your country of residence, or of the right to bring proceedings in the courts of that country where the law gives you that right.
